INSTRUCTIONS FOR COMPLETING A

PETITION FOR CHANGE IN RESIDENCY STATUS

 

 

Please carefully read the South Carolina Code of Law for "Resident Tuition and Fees" which contains residency requirements, procedures, and appeal information, for information call Scott Harvey at 864-646-1556.

 

Submit the completed petition and all supporting documentation to the following address:  (Faxes are not accepted.)

IMPORTANT INFORMATION REGARDING PETITIONS

 

·        The petition deadline is the day classes begin for the semester you are seeking in-state status.

·        Failure to complete all applicable sections of the petition may result in a denial of in-state status.

·        Only one petition may be filed per semester.

·        No requests are accepted for retroactive changes.

·        No materials or documentation will be returned after the petition is submitted.

·        The review of the petition and an initial determination of the status may take as long as four (4) weeks.

·        Read the document carefully and complete any and all sections of the petition that apply to you.

·        Parent/spouse/legal guardian application must be completed regardless of financial independence, for all applicants who are under age 24 years.

·        In the cases where affidavits are accepted, they must be dated, notarized, and contain information as specific as possible including dates, addresses, amounts, etc.  Please check in advance.

 

 

RESIDENCY CLASSIFICATION CHECKLIST

 

Please be advised that the Vice President for Student Affairs Office will be unable to accept your petition for in-state status if photocopies of the following documents are not provided with your petition. Petitions not having the required documentation will be returned to the sender.  This checklist is designed as an aid and is not a substitute for the requirements stated in the petition or residency policy.

 

·        Copy of lease, rental agreement or closing documents for home purchase. 

·        Most recently filed Federal and State Income Tax Returns. This is mandatory for all petitioners. 

·        If filing as independent, most recently filed Federal Income Tax Return for Parent/Spouse/ Guardian.

·        Documentation of all sources of income of person on whom in-state determination is to be based.  Documentation usually includes W-2 forms, 1099 forms, and most recent pay stub showing a year to date income total.

·        Vehicle registration(s) of all vehicles owned by the person on whom the in-state determination is based.

·        Driver's license for petitioner, required for all applications.  If filing as a dependent of a South Carolina resident, please submit a copy of the person on whom the in-state determination is based also.

·        Voter's Registration for petitioner, required for all applications.  When application is filed as a dependent of a South Carolina resident a copy of the person on whom the in-state determination is based must also submit a copy of their South Carolina Voter's Registration. If petitioner and/or person whom in-state determinations is based has been registered to vote in any other state they must obtain a South Carolina Voter's Registration Certificate to be eligible for in-state fees, see Section 62-605 Establishing the Requisite Intent to Become a South Carolina Domiciliary.

·        Petitioners who are not citizens of the United States must provide a copy of their Visa, Permanent Resident Card, or other applicable immigration document.  If filing as dependent person and the person upon whom the in-state determination is based is not a citizen of the United States, they must also provide a copy of their Visa, Permanent Resident Card, or other applicable immigration document.

·        Military petitioner must provide a copy of their current active duty orders.  If claiming dependence, provide a copy of the current active duty orders for the person on whom the in-state determination is based.

·        Full-time employment petitioner must provide statement from employer.  Statement must 1) verify full time employment; 2) specify number of hours worked per week; 3) state original date of employment in South Carolina; 4) specify length or term of employment; if indefinite, so state.  Statement must be on company letterhead, if the company does not have letterhead then statement must be notarized.

·        Retired in South Carolina petitioner must provide documentation of retirement and receipt of retirement income at South Carolina address.

 

Upon review of the above documentation, it may be necessary to request additional information.
